Mexico Regional Addendum

Purpose and Scope

This Mexico Regional Addendum supplements FluenTea's Terms of Service and Privacy Policy for any User or Institutional Account located in Mexico. Where a provision here is more specific or more protective than the base documents, this Addendum controls for users in Mexico, including superseding the base Terms of Service Section 3.3 age-band framework entirely for Mexican minors, per Section 1 below.

1. Minors and Parental Consent (Mexico)

Unlike the base Terms of Service Section 3.3 framework, which is built around COPPA and FERPA and allows a US school's own acceptance of the Terms to constitute consent on behalf of certain age bands, Mexican law has no equivalent school-as-agent shortcut. Article 13 of the Ley Federal de Protección de Datos Personales en Posesión de los Particulares (LFPDPPP) requires the consent of the minor's parent, mother, or legal guardian for processing any minor's personal data, for every age under 18, without exception by age band.

Required mechanism for any Institutional Account in Mexico provisioning accounts for students under 18:

The Institutional Account must obtain documented, specific consent from each minor's parent or legal guardian before that student is onboarded. A blanket institutional acceptance of the Terms is not sufficient, and neither is a general enrollment-paperwork consent obtained for unrelated purposes.
Consent must be free, informed, specific, and unambiguous (the LFPDPPP's own standard), meaning it should describe what FluenTea does, including ChaCha's AI session insights, in terms a parent can actually understand, not a generic waiver.
The Institutional Account must retain a record of each consent obtained and produce it to FluenTea or the parent or guardian upon reasonable request.
ARCO rights (access, rectification, cancellation, objection) for a minor's data are exercised by the parent or legal guardian, not the student and not the Institutional Account.
This applies to every student under 18 in a Mexico-based Institutional Account. There is no younger/older split comparable to the US 11–12, 13–15 and 16–17 bands, because Mexican law does not distinguish by age within “menor de edad.”

A student for whom no signed consent is on file cannot access FluenTea until consent is provided.

2. Aviso de Privacidad Simplificado

AVISO DE PRIVACIDAD SIMPLIFICADO

FluenTea Inc. (“FluenTea”), con domicilio en Cincinnati, Ohio, Estados Unidos, es responsable del tratamiento de sus datos personales.

Sus datos personales (incluyendo nombre, correo electrónico, información de la cuenta, y transcripciones o grabaciones de sesiones de práctica, cuando aplique) serán utilizados para proporcionar el Servicio de aprendizaje de idiomas de FluenTea, incluyendo retroalimentación generada por inteligencia artificial y, en el caso de Cuentas Institucionales, funciones de observación de sesiones descritas en nuestros Términos de Servicio.

Usted tiene derecho a acceder, rectificar, cancelar u oponerse (derechos ARCO) al tratamiento de sus datos personales. 3. Supplemental Mexico-Specific Terms

No sensitive personal data. FluenTea does not process datos personales sensibles as defined under the LFPDPPP (health, biometric data used for identification, religious belief, sexual orientation, political opinion, and similar categories), consistent with the base Privacy Policy's commitment that FluenTea does not perform biometric identification.
Cross-border transfer. Personal data is transferred to the United States and to FluenTea's named sub-processors (base Privacy Policy, Third-Party Services and Data Sharing section). FluenTea requires each recipient to maintain data protection obligations consistent with Mexican law.
Marketing opt-out. To limit the use of your personal data for marketing purposes, write to [email protected]. Marketing email from FluenTea also carries an unsubscribe link.
Enforcement authority. Compliance with the LFPDPPP, as amended in March 2025, is overseen by the competent federal authority designated under that reform.
