By accessing or using FluenTea's language learning platform, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using or accessing this site.
Permission is granted to temporarily access and use FluenTea for personal, non-commercial purposes. This is the grant of a license, not a transfer of title, and under this license you may not:
You must be at least 16 years old to create an account and use FluenTea; by creating an account, you confirm that you are at least 16. When you create an account with us, you must provide information that is accurate, complete, and current at all times. You are responsible for safeguarding the password and for all activities that occur under your account.
Users may post, upload, or otherwise contribute content to the Service. You retain ownership of your content, but grant us a license to use, store, and share your content as necessary to provide the Service.
You are solely responsible for all content that you post, upload, display, share (including through screen sharing in calls, classes, and channels), stream, or otherwise transmit while using the Service (“User Content”), and for compliance with all laws that apply to your User Content. You represent and warrant that you own your User Content or that you have obtained all rights, licenses, and consents necessary to use it on the Service, and that your User Content does not and will not infringe or violate the rights of any third party, including intellectual property, privacy, and publicity rights.

Important: Users who are reported for inappropriate behavior or who use the platform for purposes other than language learning may have their accounts suspended or permanently removed at our sole discretion. We reserve the right to investigate reports of misconduct and take appropriate action to maintain a safe learning environment for all users.

We will always notify you when recording features are active and obtain your consent before any recording takes place.
Your use of our Service is also governed by our Privacy Policy. Please review our Privacy Policy, which also governs the Site and informs users of our data collection practices.
The Service and its original content, features, and functionality are and will remain the exclusive property of FluenTea and its licensors. The Service is protected by copyright, trademark, and other laws.
Respect for the intellectual property of others. FluenTea respects the intellectual property rights of others and expects users to do the same. You may not post, upload, share, screen share, distribute, or reproduce through the Service any copyrighted material, trademarks, or other proprietary information without the prior consent of the owner of such rights. Teachers, schools, and other organizations that use the Service to deliver instruction are solely responsible for obtaining all rights, licenses, and permissions required for any textbooks, course materials, or other third-party content they present, share, or upload through the Service. FluenTea does not review, monitor, or approve the materials users choose to teach or study with, and is not responsible for determining whether those materials are properly licensed.
FluenTea responds to notices of alleged copyright infringement in accordance with the U.S. Digital Millennium Copyright Act, 17 U.S.C. § 512 (“DMCA”), and with corresponding notice-and-takedown procedures under other applicable laws, including Articles 114 Septies–114 Octies of Mexico’s Federal Copyright Law (Ley Federal del Derecho de Autor).

Upon receipt of a valid notice, we may remove or disable access to the identified material and will make reasonable efforts to notify the user who provided it. That user may submit a counter-notification containing the information required by applicable law; if we receive a valid counter-notification, we may restore the removed material unless the original complainant informs us that it has filed a legal action within the applicable statutory period.
Repeat infringer policy. We will, in appropriate circumstances, terminate the accounts of users who are determined to be repeat infringers. We may also, at our sole discretion, remove content, limit access to the Service, or terminate the account of any user who infringes the intellectual property rights of others, whether or not the infringement is repeated.
Knowingly submitting a materially false notice or counter-notification may result in liability under applicable law.
We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.
Upon termination, your right to use the Service will cease immediately. You may also delete your account at any time through the account settings.
The Service is provided on an "AS IS" and "AS AVAILABLE" basis. We make no warranties, expressed or implied, and hereby disclaim and negate all other warranties including, without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement.
In no event shall FluenTea, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses.
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days notice prior to any new terms taking effect.
